PLEASE READ OUR TERMS AND CONDITIONS AS THEY FORM PART OF YOUR HIRE CONTRACT. BY ACCESSING AND COMMITTING TO THE YARRA VALLEY DRESS HIRE PROCESS, YOU AGREE TO THE TERMS AND CONDITIONS LISTED HEREIN. YARRA VALLEY DRESS HIRE RESERVES THE RIGHT TO CHANGE THESE TERMS AND CONDITIONS FROM TIME TO TIME AT ITS SOLE DISCRETION. THESE AMENDMENTS WILL BE PUBLISHED WITHIN 24 HOURS OF CHANGE.
YARRA VALLEY DRESS HIRE (ABN: 33 034 030 433), is hereinafter referred to as "YVDH", "we", "us", "our".
This Contract contains all of the Terms and Conditions regarding the hire of products from Yarra Valley Dress Hire. As this is a legally binding contact, our products may be hired by customers over the age of 18 years old only. Customers who allow minors under the age of 18 to wear our hired products consent to accepting full responsibility of the hired product under this Contract. By signing "I accept hire" you represent that you are over 18 years, agree to this Contract and are authorized to use the chosen method of payment with the purpose of hiring the products on the order.
By placing a booking with YVDH, you are entering into a legal binding Contract with YVDH and agree to these Terms and Conditions. A booking is subject to acceptance or rejection at our sole discretion after receipt of the booking. At the time of booking you shall receive a confirmation of your booking via email. Should you not receive a confirmation of your booking, this may mean we have not received your booking or it has been rejected at our discretion. If this is the case, please contact YVDH to confirm the status of your booking as a matter of priority, to ensure we have time to rectify any potential issues for your booking to be successful.
We may at any time following receipt of your booking accept, decline, or limit your booking for any reason whatsoever before the products are delivered to you. If you have made a payment specific to the booking, we will refund you if the booking is cancelled by us.
By entering this Contact you consent to the understanding that we are a hire service with multiple customers and limited garments. YVDH will take all necessary steps to ensure that your booked garment is available for your booked dates. In the unlikely event that the garment you have booked has been hired prior by another customer which has resulted in that garment being damaged beyond repair or not returned, YVDH will not be held liable for any necessary cancellations of future hires as a result. Should this occur, YVDH will take every step necessary to offer you a suitable alternative for your desired booked dates. Should you wish you acquire a replacement garment, YVDH will book this for you with a 50% discount for your inconvenience and waive all postage costs. YVDH will offer a full refund should this be requested.
YVDH only accepts booking requests for dress hire within Australia. No dress hire items will be delivered outside of Australia.
At checkout, you have the option to hire our garment for a term of four or eight days. The hire period shall begin when the garment/s are collected instore or delivered to your nominated address or PO BOX.
YVDH endeavours to provide the most accurate description of our garments available for hire. We encourage all garments to be tried on prior to hire, however if this is not a possibility, and you receive your hired garment unsatisfied, you will be entitled to a credit note for the following reasons:
If the garment does not fit or is not right for any reason you must notify YVDH within 24 hours of receiving said item via email.
Your item must then be returned to us either via post or drop off within 24 hours of delivery.
If we deem the garment has been unworn a credit note will be issued which will be valid for twelve months.
The 'hire fee' for the products will be the hire fee and delivery fees and any additional charges listed in this Contract or Instore, in relation to you hired products. When you order a product you authorize YVDH to charge your payment method for your hire fee. In addition to your hire order, you authorize YVDH to charge your payment method up to an amount to 200% of the entire original retail value of the product as set in the "RRP" at booking. We only charge your payment method when you have not upheld your commitment to us as set forth in the hire Contact herein. In the event an invoice is issued for payment for any reason then payment shall be due within seven (7) days of the date of the invoice. We may ask for photo ID, credit card details or other forms of identification. We can refuse the right to hire if you are unable to provide the requested identification or document(s). If we have requested this information it is your responsibility to provide this information immediately. In the event we are unable to fulfil your hire or delivery on time due to the information not being provided a credit only will be applied, no refunds will be given.
PLEASE NOTE: YOUR ORDER WILL NOT BE DESPATCHED UNTIL FULL PAYMENT IS RECEIVED.
All orders that are organised for collection from YVDH premises must be collected on either a THURSDAY, FRIDAY or SATURDAY. If any other collection days are required, these must be communicated with YVDH to ensure your order is ready and align within the requested booking timeframe chosen.
All orders for dress hire with YVDH that require postage and needed for the coming weekend MUST be placed no later than Tuesday 1pm. No orders will be accepted after this time unless you communicate directly with YVDH via either phone or email. We will endeavour to provide your chosen dress in the time we have, and direct communication between us both will help make this a possibility.
If we deem your order has a chance of reaching you in time, we will post said order. If for any reason you do not receive your order in time. You are entitled to a credit note to use within YVDH, for dress hire purposes only, with an expiration date of twelve months.
For all normal bookings...once your order leaves our premises with a third party courier service, YVDH is responsible for communication with the courier service. If YVDH has posted your order within the expected timeframes of you receiving your order before your booking date and you do not, YVDH will be responsible for communication with the courier service. If the courier service has delayed or lost your order through no fault of YVDH, you will be entitled to a full refund.
Should you provide incorrect delivery instructions, delivery address, or are not at home at the time of the attempted delivery resulting in the courier returning the delivery to the depo you agree under these Terms and Conditions that you are responsible should this affect your booking. YVDH are not responsible if your booking date is missed due to the aforementioned possibilities. We will not issue a refund in this instance. You will receive a credit note for the dress hire minus any delivery charges.
By accepting this Contract you consent to the understanding that we provide an 'Authority to Leave' your parcel at the time of delivery by our chosen courier service. At the time of delivery, if and when the courier leaves your parcel at an acceptable place (mainly at your front door unless an alternative is provided by you at the time of booking) you accept you then become liable for the delivery and any damages or losses incurred. YVDH is not responsible for your order once the courier has completed their delivery and we receive notification of this.
In the unlikely event that an order is delivered and accepted by you after your booking date for any reason, as part of your booking contract, you MUST return said order to YVDH within 48 hours. Failure to do so will result in you being charged a 'late' or 'not returned' fee.
If the item is received damaged or faulty, YVDH must be notified within 5 hours of the item being delivered. Photo evidence must be provided and emailed to YVDH. If these steps are not taken, YVDH may deem you are responsible for the damage and 'damage charges' will be issued to you. We strongly recommend that all orders received are thoroughly inspected by you at the time of receipt to avoid any disputes upon return. All final decisions made by YVDH Management in regards to damaged or faulty returns are accepted by you as final decisions as acceptance of these Terms and Conditions.
On return, you agree to deliver the garment instore or via our Drop Box option no later than the last day of your hire period. If you are posting the garment back to us using the provided return satchel, you must place this satchel in the mail no later than the last day of your hire period. The time it takes for this satchel to travel via post from your location to ours, is not included in your hire timeframe.
We offer a free Drop Box service for all returning orders. Our Drop Box is located on our premises and is monitored under 24 hour video surveillance. Our Drop Box is physically checked and emptied numerous times daily. Your request to use this return option needs to be communicated with YVDH at the time of placing your booking. Once you return your garment to us via the Drop Box option, you do not need to do anything further. You will receive a confirmation email stating we have received your return. Should you not receive a confirmation email from us, we may be under the assumption your order was not returned. If for any reason we believe your order was not returned and there is a dispute, we will review our video footage of your deposit and a decision will be made by management to finalize matters. You agree to accept our final decision in this matter as part of agreeing to our Terms and Conditions. If our Drop Box is tampered with, footage will be reviewed and potentially forwarded to authorities. Should our Drop Box be tampered with and your returned garment is damaged or stolen, if our footage shows you have returned the garment as per our agreement, we will take full responsibility for said garment and you will not be changed any 'damage' or 'late' fees. Should we review footage and you have not returned the garment, you will be charged 'late' or 'not returned' fee.
If you choose to return your order via return post, a return post satchel will be provided with your received order. You cover this return post cost as part of your hire fee. Please note we remove the tracking sticker from the satchel we provide so we can track the parcel coming back to us. If you wish to track yourself please make a note of the tracking number on your satchel and you can track this via Australia Post's website.
We highly recommend you return your order via an Australia Post Outlet where it will be scanned over the counter as proof of lodgement. This ensures you will not be responsible for late fees should an Australia Post Box not be emptied or tampered with.
Should this provided satchel be lost or damaged during your hire period and need replacing, you will be liable for the costs involved. You will be liable for the cost of replacing the satchel and return delivery expenses. Your original return fee charged will not be reimbursed. YVDH will not be held liable for garments which are late or lost in transit due to your chosen method of shipping.
Professional cleaning is included in your hire and you agree that no attempts will be made to clean, alter, iron or press any hired garment. All garments are professionally steamed prior to sending however can become creased in the post. Certain fabrics are more prone to wrinkles though, and if you receive a dress with slight creases, please try steaming the garment on low heat. Alternatively, you can hang the dress in a steamy bathroom and the steam will de-crease it. If you need further assistance please contact us for advice.
YVDH shall not be held liable for any health-related complaints associated with a product rented from our site. Our products have been worn by other consumers prior to your rental.
You may cancel your order subject to the following cancellation fees and policies:
14 days out - Cancellation fourteen (14) or more days in advance of the delivery date, there is no cancellation fee and you will receive a full refund issued to the payment card you used for the order.
7 days out - If you cancel less than fourteen (14) days but more than seven (7) days in advance of the delivery date, you will not receive any refund, but you will receive a credit note for the Hire Fee associated with the cancelled order. This credit can be applied to any future hires placed within twelve months of the cancellation date.
Less than 7 days out - If you cancel seven (7) or fewer days in advance of the delivery date, you will receive a credit note for the Hire Fee associated with the cancelled order, minus the postage cost and a cancellation fee of $10.95
*All orders placed using AfterPay will incur a $10.95 cancellation fee.*
You agree to return your garments on the booking return date (or next business day if your return date falls on a Sunday or public holiday) using the prepaid return satchel provided. If you return your garments late you will incur a $20 for Standard Hire and $40 for Couture Hire late fee for every day you are late up to 120% of the retail value of the dress as indicated on your booking.
You agree to pay these late fees up to an amount not exceeding 120% of the retail value of the products. If you have not returned your garment within 20 days of the return date your garment will be considered a non-return.
You agree to treat our products like you would your own. You will treat the garment with the upmost of care.
We offer free damage insurance to the value of one hundred dollars ($100) to cover minor damage. For minor damage if YVDH assesses (at its sole discretion) that the cost of repairs will be over one hundred dollars ($100), then you will be required to pay the difference (e.g. if the repair cost is one hundred and fifty dollars ($150), then YVDH will require you to pay fifty dollars ($50). If YVDH assesses (as its sole discretion) that the dress is not repairable, you will be charged the full replacement value of the dress. If YVDH deems the dress has been purposely damaged beyond repair or is not returned, you will be charged the replacement value of the dress as stated at booking + 10% on top for Standard Hire and 20% on top for Couture Hire. Dresses considered irreparable are not covered by the $100 insurance.
If you do not pay the amounts owed to us when due we will pass on the invoices to a collection company to pursue you for collection, including and without limitation attorney and collection fees. YVDH reserves the right to terminate your right to rent products from us at any time at our own discretion should you breach this agreement or for any other reason.
All property purchased and owned by YVDH which is hired by you under this contract, is and will at all times remain the absolute property of YVDH. If you (the User) fails to return the hired property to YVDH then YVDH or a YVDH agent may (as the invitee of the User) enter upon and into land and premises owned, occupied or used by the User, or any premises where the property is situated and take possession of the property.
We will use the information from your order to send you email marketing on occasion. You may opt out of receiving those emails by emailing theteam@yvdh.com.au. We will not at any stage pass on any of your details, including but not limited to, your email address, residential address or financial details to any other companies or corporations.
You may upload pictures, photographs, graphics, Information, comment, content, communication, text or other material regarding YVDH to any social media with or without our consent.
By agreeing to this Contract you allow us to use your uploaded aforementioned content for our business promotional needs.
You retain all Intellectual Property Rights in your content uploaded and shared. By uploading your content, you grant us a perpetual, non-exclusive, royalty free, irrevocable, transferable and worldwide licence (including the right to sub- license) to use, adapt, copy, communicate, reproduce, modify, display, exploit, publish, re-distribute, broadcast, transmit, create derivative works from and incorporate in other works, your content, at any time in the future in any form and for any purpose (including but not limited to promotion or advertising use in the future including publishing on social media channels).
Where you upload photographs, pictures, graphics, comment or other content through social media channels such as but not limited to Facebook and Instagram using hashtags related to us or where you otherwise tag us, you grant us a permission to such content in the same manner set out above.
We may access or examine any of your content and at our discretion remove, block, modify, edit, refuse to upload or disable access to your content which directly relates to YVDH and we consider, in our sole discretion, to be otherwise unacceptable.
